Collection and Use of Information
When you place your first order with Channel Films, we ask you for your full
name, email address, age and possibly your credit/Debit card number so we can license and distribute
your film. We use your age only to verify that you're old enough to view some of the
content. You (the account holder) must certify that you are at least 18 years
old. People under 18 cannot use Channel Films without the concent of an adult.
At times, we may ask you to provide some generic demographic information to
better assist our customer service and company direction. You are not required
to provide us with this information, and if you do participate we will reimburse
you with promotion vouchers to use on Channel Films. If you want to update your
address or change credit cards, go to My Account and make the appropriate
changes. You must be signed in to access My Account. We also track your order
and billing history so you can access My Account and immediately determine which
films you have rented or purchased and how you paid for them.
Cookies
The Channel Films website will place cookies on your computer's hard drive.
(Cookies are small pieces of data that are sent to your browser from our Web
servers and stored on your hard drive.) Cookies allow us to match your account
information with our systems so that you don't need to retype information each
time you visit our website. If your browser is set to not accept cookies, you
will not be able to use the Channel Films website or VoD service. Channel Films
will not authorise third parties use of cookies generated by our websites or
services.
Viewing and Updating your Information on Channel Films
You can always access the personal information you provid Channel Films by going
to My Account. You can make changes to this information at anytime. Any change
to information that Channel Films depends on to provide your service may be
delayed for verification in order to ensure the information we hold is accurate.
Disclosure
Except as described in this section, we will not sell, rent or disclose your
personally identifying information to third parties. We hold the right to use
ambiguous demographic information and trends to better our service. For example,
we may analyse the films you rent or purchase so that we can better market and
focus on content you may like. We may use your information to contact you by
email, post and telephone in relation to your account or service. Any
newsletters, promotions or adverts will require you to opt-in. We will not be
liable for any damages that may result from the misuse of your personal
information. Channel Films reserves the right to disclose information when
required by law. Customers should check back for updates to this policy.
Film Licenses
All film licenses obtained through Channel Films are authorised play throughout
their valid license period and may be subject to continuance of your Channel
Films account, subscription or service. Downloaded or issued Films maybe
protected by a DRM (digital rights management) mechanism to prevent unauthorised
distribution and viewing. Licenses for Film Purchases (Bought-to-Own) can be
re-authorised "once" providing your Channel Films account is still valid and
active. License Re-Authorisation requests must be sent via the Channel Films
Support Ticket System, and are subject to verification and approval.
Security and Access
For transmitting your personal information to us, we use a secure server (SSL),
which encrypts all of your personal information. This encryption process ensures
that the information you give us is protected against unauthorized access. You
can access My Account from every page on the site to update and correct your
name, email address, password, postal address, credit cards, and mailing list
preferences. Please note that you must be signed in to Channel Films to access
this information. We have implemented technology and security features, to the
accuracy and privacy of your personal information. We have taken measures to
help protect your information from unauthorized access or improper use. We will
continue to enhance our security procedures as new technology becomes available.
While we make every effort to ensure that your information is secure on our
system, no data transmission over the Internet can be guaranteed to be 100%
secure and therefor cannot guarantee your information will be safe from
hackers/fraudsters. Online payments are processed by either SagePay or PayPal
and Channel Films does not directly store your Credit or Debit card on
any databases or systems even if the information was provided to our websites or
services.
Refunds
Channel Films will refund any Film Rental that hasn't been watched or where no
DRM license has been issued. Channel Films will refund Film Purchases (bought to
own) that either hasn't been watched, or where no DRM license has been issued.
If you encounter problems with DRM Licenses, we will try to resolve any problem
with DRM delivery before issuing a refund. All refund requests must be raised
via our Support Ticket System. No Refunds can be given on payments for TopUp
Site Credit. Any refunds for Film Rental/Purcahses where Site Credit was used will be
reallocated as Site Credit. No refunds can be given to rental / purchases
obtained by Voucher. Vouchers have no cash value outside of the Channel Films
Website.
Notice and Procedure for Making Claims of Copyright Infringement
If you believe that your work has been copied in a way that constitutes
copyright infringement, please provide Channel Films with written information as
specified. Please note that this procedure is exclusively for notifying Chaanel
Films and affiliates that your copyrighted material has been infringed. An
electronic or physical signature of the person authorised to act on behalf of
the owner of the copyright interest; A description of the copyrighted work that
you claim has been infringed upon; A description of where the material that you
claim is infringing is located on the Site or Service; Your address, telephone
number, and e-mail address; A statement by you that you have a good-faith belief
that the disputed use is not authorised by the copyright owner, its agent, or
the law; A statement by you, made under penalty of perjury, that the above
information in your notice is accurate and that you are the copyright owner or
authorised to act on the copyright owner's behalf.
Intellectual Property
The materials displayed on or contained within this Site including, without
limitation, all Site software, design, text, editorial materials, informational
text, photographs, illustrations, games, audio clips, video clips, short
features, artwork and other graphic materials, and names, logos, trademarks and
service marks (the "Materials"), are the property of Channel Films or its
licensors and are protected by copyright, trademark and other intellectual

further agree that you will not disassemble, decompile, reverse engineer or

Cancellation of Service or Close of Account
You may at any time request your Channel Films account to be closed and services
cancelled. Any Film Licenses obtained through Channel Films may be lost or
deleted once your account has been closed. Distributed DRM Licenses will
continue to work for the duration of their license period. Licenses for Film
Purchases (Bought-to-Ow) cannot be re-issued / re-authorised once your account
has been closed, and cannot be re-associated or re-authorised if you signup
again. Unused Site Credit cannot be refunded and will be forfeited.
Termination
These Terms and Conditions (and therefore your license granted herein, including
the license to use content, unless downloaded and protected by DRM) shall
terminate automatically and immediately if you fail to comply with any of the
limitations or requirements described. If you breach these Terms and Conditions,
you must destroy any copy of Downloaded Content (including any Retained and DRM
Protected Content) that you have in your possession. DRM Licenses can be revoked
without warning. No notice shall be required from Channel Films to effectuate
such termination.
